Welcome to the Privacy Policy for www.GlobalGolf.ca, a website operated by Worldwide Golf Canada, Ltd. (collectively, “GlobalGolf,” “we,” or “us”). Your privacy is very important to us. This Privacy Policy explains how personal information about you is collected, used and disclosed by GlobalGolf with respect to your use and interaction with GlobalGolf and www.GlobalGolf.ca (“GlobalGolf.ca” or the “Site”), including when you purchase products on the Site (the “Services”).
It is our policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and / or an individual’s right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of federal and provincial privacy laws in Canada, as applicable.
This Privacy Policy has a limited scope and application. Consequently, the rights and obligations contained in this Privacy Policy may not be available to all individuals or in all jurisdictions. 1. Use of Information
GlobalGolf.ca may provide certain demographic information it collects to third parties in connection with its provision of Services to our Users. The dissemination of this information is necessary in order to provide personalized information and promotional offers. GlobalGolf.ca may provide our promotional affiliates with personal information which would permit them to communicate with our Users by email if the User “opts-in” to and has not “opted-out”, pursuant to our opt-out procedure, from receiving such communications. You may have the opportunity to ask us to provide your information to these promotional affiliates. We expect those promotional partners with whom we share information (with consent, as provided herein) to respect the privacy of our Users in the same manner as we do. However, we cannot ensure that they abide by our privacy policies.
The information we collect may also include information you submit about others, including the name, e-mail address or physical address of a gift recipient. We only use information you submit about other people to deliver information, products, or services specifically requested by you or as otherwise required or permitted by law, including to cooperate with law enforcement officials in the investigation of alleged unlawful activities of our customers.
2. Personal Information
We collect information in three primary ways:
- You give us information: We collect information from you when you create an account with us, sign up to receive marketing communications, purchase a product from us, or when you interact with us about a product, service, or promotion we offer.
- We collect information automatically: We automatically collect certain types of personal information when you visit GlobalGolf.ca. For example, we automatically collect various types of technical information when you use GlobalGolf.ca as described in this Privacy Policy.
- We collect information from other sources: Subject to applicable law, we may obtain information about you from outside sources. For example, we may obtain commercially available information about you from third parties, such as demographic information for advertising and marketing purposes. We may also receive information from third parties who provide third-party tracking services through web-beacons as otherwise discussed in this Privacy Policy.
Our registration format requests certain contact information from our Users. We collect personal information through the registration and purchasing process when processing your order. When a User completes an order, the format will require personal information for each User, including:
- Contact information (including name, home address, email address)
- Unique identifiers (including credit card numbers)
- Demographic information (including zip code, telephone area code, age, birth date, gender, income level, etc.)
The information we have obtained through this process may be used by GlobalGolf.ca, as well as by providers of related services, in connection with processing your order. We also use contact information from the registration format to send the User information about us and when otherwise necessary. Such information may also be used to assess your satisfaction with and to obtain feedback regarding the Service we provide and to tailor the visitor’s experience while visiting the Site.
We may use the contact information we collect to provide, by means other than email, information or offers which we believe will be of value to Users and we may share contact information with other companies that may want to provide our Users, by means other than email, information regarding additional products and services. Subject to the terms of this Privacy Policy and applicable laws: (i) we may also use the contact information to send our Users information or offers by email which we believe will be of value to them; and (ii) we may share email contact information with other companies that may want to provide our Users information regarding additional products and services. Such contact information may be shared based upon the demographic information we collect. Users may opt-out of receiving future communications at any time; see the section below regarding ”Opt-out”.
As is true of many if not most websites, we collect certain information automatically and store it in log files by using cookies and other automated technologies. For more information on our use of cookies, please see below in the “Cookies” section of this Privacy Policy.
In addition to any personal information or other information that you choose to submit to us, we and our third-party service providers (including content and analytics providers and advertising companies) may use a variety of technologies that automatically or passively collect certain information whenever you visit or interact with GlobalGolf.ca or one of our advertisements or other content elsewhere online (collectively referred to as “Usage Information”). Usage Information may include the browser, search terms you use; the URL that referred you GlobalGolf.ca; all of the areas within GlobalGolf.ca that you visit, the time of the visit, the links you select from GlobalGolf.ca to elsewhere online, among other information about your visit.
Our systems may also automatically collect your IP address or other unique identifier of your computer, cell phone, or other device used to access GlobalGolf.ca (collectively referred to as a “Device Identifier”).
Usage Information and Device Identifiers may be non-identifying or may be associated with you and therefore identifiable. Whenever we associate Usage Information or a Device Identifier with you, as an individual and identifiable person, we treat it as personal information. As described in further details in the “Cookies and Web Beacons” section below, we may use Usage Information and Device Identifiers to gather information about individual users and market segments, to monitor the Site’s performance and for our business purposes, such as improving our products and services and upgrading the Site.
Note that your browser settings may allow you to transmit a “Do Not Track” signal to websites and online services you visit. Like many websites and online services, GlobalGolf.ca does not respond to a “Do Not Track” signal from a visitor’s browser. Finally, the information we collect will be maintained in a file that we may need to review in a variety of other circumstances, such as enforcing our Terms of Use for Users, analyzing and understanding our customers and their needs, and for the administration and provision of our goods and services. Unless you expressly advise us otherwise, we may use your personal information for the purposes described in this policy, including the provision of information to service providers that facilitate the Service, all in accordance with this Privacy Policy. You may change or withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. All communications with respect to such withdrawal or change of consent should be in writing. In some circumstances, withdrawing or changing such consent may affect: (i) our ability to provide you with products or services; and/or (ii) your ability to access the Site.
3. Aggregate Information
Subject to the other terms of our Privacy Policy, we may de-identify, anonymize or otherwise aggregate (i.e. assemble on a basis that does not enable one to personally identify you) the data that is acquired under or in connection with this Site and/or related to ordering our products and services, including, without limitation, data about the products and services requested and purchased by our Users. Such data may be used by us to improve our Services and for marketing purposes, and may be shared with and used by advertisers and other third parties. We may also use such data to determine what types of services are best suited for our customers and what types of services our customers request. If we provide aggregated data to third parties, personal information (including birth date, name, title, income level, home address, dependent information and any other identifying information) will not be individually identifiable in the aggregated data.
Notwithstanding anything in this Privacy Policy to the contrary, GlobalGolf.ca has contracted with third parties to provide tracking and analysis of information and data collected from visitors to our website. GlobalGolf.ca reserves the right to provide that information and data to such third parties for those purposes. Such information and data is provided on a basis that does not enable a third party to identify you.
Your use of the Services provided by GlobalGolf.ca constitutes your consent to the use of such data on an aggregated basis.
4. Policy on Children’s Use of the Site
This Site is, generally, directed at persons over the age of 13 who purchase items with credit cards and we do not knowingly collect personal information from or about children under the age of 13 except as relating to a specific order for products or services. If we, at any time, learn that information relating to a child under the age of 13 that we have obtained is other than as set forth above, we shall make reasonable efforts to purge such information from our records, except when otherwise required by law.
5. Cookies and Web Beacons
Like most other Web sites, GlobalGolf.ca’s servers may automatically track certain information about activity on the Site. This information allows us to keep the Site running efficiently. This information may include: the browser being used (such as Internet Explorer, etc.); your operating system (such as Macintosh, Windows, etc.); your IP address; and the referring URL and all company URLs you visit. We use your IP address to help diagnose problems with our server, and to administer the Site, but your IP address is not connected to information that is personally identifiable.
Cookies: In addition, GlobalGolf.ca may use “cookies” on certain pages of the Site to automatically collect information from a visitor to the Site and transfer this information to the visitor’s hard drive. Cookies help us recognize repeat visitors, allowing communication of a personalized welcome message and tailoring of content to match particular interests. We may also use cookies to collect information on inactive online shopping carts and may use this information to send SMS text message reminders to individuals enrolled in our mobile alert program within one hour of inactivity/lack of purchase.
We also may use outside advertising companies to display advertisements on our site. These advertisements may also contain cookies. Some customer data may be shared with the advertising affiliates on an aggregated basis in accordance with the other terms of this Privacy Policy. If you decline “cookies” or delete them from your computer, you will still be able to access the Site, but you may find that some areas do not work as smoothly as when cookies are enabled on your system.
Web Beacons: GlobalGolf.ca and certain emails sent to consumers who have not disabled their browsers for web beacons and cookies contain electronic images (called “pixels”, “transparent GIF files”, or “web beacons”) that allow us and our advertising partners to view and access cookies. In general, any electronic image viewed as part of a web page, including an ad banner, can act as a web beacon. A web beacon is a transparent graphic image placed on a web page or in an email, which indicates that a page or email has been viewed or that an email has been forwarded. In some cases, these files are provided by our online management partner. These files enable our online management partner to recognize a unique cookie on your web browser, which in turn enables us to learn which advertisements bring users to GlobalGolf.ca. The cookie was placed by us or by another advertiser that works with us. We may also include web beacons in HTML-formatted newsletters and other emails containing graphics that we send, so we may count the number of newsletters and emails that have been opened and read.
6. Unsolicited Email and Text Messages
Email: GlobalGolf.ca does not send unsolicited bulk emails to anyone who has requested that we do not contact them. We send our newsletters to those who have subscribed to receive them. If you have inadvertently received one of our newsletters or other marketing communication, or if you simply wish to stop receiving them, please follow the “unsubscribe” instructions contained in each newsletter or send a request to be unsubscribed at privacy@gvcommerce.com. We may still send you emails that do not contain marketing, like transactional emails should you purchase merchandise via GlobalGolf.ca or email notifying you of policy changes including to this Privacy Policy.
Text Message Programs: You may elect to receive text messages from us in accordance with our Terms of Use. Data obtained from you in connection with any text message services may include your cell phone number, your provider’s name and the date, time and content of your text messages. We may use this information in accordance with our Privacy Policy to contact you and to provide the services you request from us.
7. Other Use
It is possible that GlobalGolf.ca, its business and/or assets, its present or future subsidiaries, joint ventures or any combination of such, could merge with or be acquired in one or more types of transactions by another business entity or entities. Should such transaction(s) occur, GlobalGolf.ca may share some or all of your information, including personal information, in connection with any such transaction and/or allow any successor entity to continue one or more services similar to all or a portion of the Services that GlobalGolf.ca currently provides. Notice of such an event (to the extent that it takes place) will be posted on the Site and we will require that the new combined entity adhere to the practices disclosed in this Privacy Policy.
8. Disclosure for Legal Purposes
Given the government’s current interest in Internet regulation, we may disclose your personal information pursuant to judicial and administrative proceedings, and in connection with law enforcement activities and as otherwise may be permitted or required by law, to law enforcement or government agencies if we believe the disclosure is necessary or appropriate. We may also disclose your personal information if we believe the disclosure is necessary or appropriate in the event of an investigation of improper or illegal conduct in connection with the Site, such as fraud, misrepresentation, intellectual property infringement, breach of contract, or other activity that may put us at risk for liability. We may, to the extent permitted or required by law, inform a User whose information may be so revealed.
9. Other Parties and Your Information
This policy only relates to our collection and use of your personal information, except as otherwise provided. We may share your information (including personal information), where consistent with this Privacy Policy and applicable laws, with third party businesses and service providers that assist with our business operations, such as shipping vendors, billing or other payment vendors, payment card processors, IT services, customer service, email and text delivery services, marketing and research vendors and various companies that work with us to improve or provide our products and services and our data integrity including advertising networks and data analytics providers. While we are not involved in the day-to-day operations of such businesses and providers, our agreements generally obligate them to use reasonable methods to keep any personal information safe and secure, and not use such personal information for purposes other than providing their applicable services. However, even if a third party business or service provider is performing business operations on our behalf, if you have an independent relationship with such third party business or service provider, its use of your information may be governed by its independent relationship with you, and we are not responsible for such use. We are not responsible for the privacy policies and practices of promotional affiliates or other third parties to which we may provide links. GlobalGolf.ca does not have control over the privacy policies applied by any other party to whom you may disclose information to when linked from the Site. If you would like information on any other party’s privacy policy, you should contact that party directly, and we encourage you to do so.
10. Security
GlobalGolf.ca endeavors to employ standard industry measures designed to protect the confidentiality of your personal information, including the use of firewalls and SSL encryption. We also endeavor to ensure not to retain personal information about you for a duration greater than as provided or permitted by law, rule or regulation.
We believe we employ security measures that adequately address the security needs of our GlobalGolf.ca customers. Unfortunately, no data transmission over the Internet or any wireless network is 100% secure. As a result, while we strive to take reasonable measures to protect your personal information, we cannot ensure, guarantee or warrant the security of any information you transmit, and you do so at your own risk.
11. Your Rights and Choices About the Information We Collect
To the extent permitted by applicable law, you have the right to request a copy of your personal information that we maintain in our systems and databases and,
where appropriate, request that we update, correct, or delete your personal information, or that we no longer contact you.

Please note that any such communication must be in writing. Also note that any right to update, correct, or delete the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices. In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.
Please be aware that it is not always possible to completely delete, erase, or comply with your request with respect to all of your personal information without some residual data backups in our systems and databases, because we still need to process your personal information for the purpose the data was collected, or we need your information to comply with legal obligations, perform contracts, resolve disputes, and for other legitimate reasons.
We are also unable to delete your transactional data related to your purchases and returns because we need to keep these records as long as required or permitted by applicable law.
If we are precluded from honoring your request to delete your personal information, we will inform you of the reasons for the rejection. We will process all such requests within 30 days of receipt or within such other time as specified by applicable law.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure so that we do not disclose personal information to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. Your personal information may be retained by us for as long as the purposes for which the personal information was collected continue and require it, or if the retention is necessary for our legal purposes or otherwise required by law. For example, we may need to retain your personal information if we need to defend a legal claim or in case of a dispute. In addition, we retain the right to keep non-identifiable information for research and development purposes to improve our products and user experience. Should you have opted-in to GlobalGolf.ca marketing, we will retain your personal information for marketing purposes until you notify us (by opting out) that you no longer wish to receive marketing materials from us.
You can review and modify (or remove) the information you provide us in the order or registration process if this information changes. The information that you may change (or remove) includes any information provided on our order or registration format. To make any of these changes, you may log on to this site and make the changes directly after you have received an identification and password for the transaction or for the individual order.
After either completing your first purchase at GlobalGolf.ca or otherwise using our registration module, your registration on the Site will be confirmed by an email correspondence to your email address. If you have completed a purchase on the Site and do not object to such email within three days, it will constitute your consent to receive email notices and other email communications from GlobalGolf.ca. You may also provide your express consent to receive email notices and other email communications from GlobalGolf.ca and its advertisers and promotional affiliates. In the event you no longer wish to receive such email notices or other email communications from us, you may opt-out by removing yourself through our opt-out procedures. In the event you no longer wish to unsubscribe from receiving promotional email communications from GlobalGolf, you may opt-out by:

If you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, such as notifications regarding your orders, or as otherwise consistent with applicable law.

14. Interpretation of this Privacy Policy
Any interpretation associated with this Privacy Policy will be made by us. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples; therefore where the word “including” is used, it shall mean “including without limitation”.
This Privacy Policy does not create or confer upon any individual any rights, or impose upon GlobalGolf any rights or obligations outside of, or in addition to, any rights or obligations imposed by Canada’s federal and provincial privacy laws, as applicable. Should there be, in a specific case, any inconsistency between this Privacy Policy and any applicable federal and provincial privacy laws, this Privacy Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such privacy laws.
